Assigning Funds

Upon receipt of a Letter Of Intent (indicating the grant amount) and a fully executed Grant Agreement (signed by the Minister of Culture) it is possible to partially or fully assign your Alberta Production Grant (APG) grant to a lender of your choice for interim financing (as APG grants are payable on completion of a production).

The following 5 steps are required to assign funds to a lender:

1. The Producer and their Lender create a Loan Agreement. (The content and terms of this agreement are determined by those parties, independently of the Alberta Multimedia Development Fund. A copy of the Loan Agreement is not required in the assignment of funds package.)

2. Based on the template provided, the Producer and Lender prepare an Assignment Agreement in duplicate.

NOTE: Our sample does not in any way constitute legal advice to a potential assignor or lender. Each party must determine what is to be included in its Agreement to meet their respective needs. Under normal circumstances, and without in any way binding its future discretion, Alberta Culture (AC) is prepared to execute the Loan Agreement where it applies to an Assignment Agreement and Notice of Assignment in similar form as this sample.

3. The Producer and the Lender sign the Assignment Agreements. Please ensure that all numbers and figures are correct and that this document includes:

  1. the signing date of your Loan Agreement;
  2. the signing date of your Assignment Agreement.

NOTE: If Assignment Agreements are not signed by the Producer and the Lender they will be returned to the sender and the Assignment process will be delayed.

NOTE: If you require more than one original copy, please include the appropriate number of document packages with original signatures.

4. The Producer creates a Notice of Assignment and Irrevocable Direction using the template provided. This must be signed by and dated the producer.

NOTE: Please ensure that you have entered the signing date of your Loan Agreement, Grant Agreement and Assignment Agreement into your Notice of Assignment and Irrevocable Direction.

5. Submit the complete package to the AMDF office for approval and execution.
